Supreme Court Refuses to Consider Texas Election Lawsuit Based on Original Jurisdiction
The position of the Supreme Court raises an important question that now sits unresolved. If an individual citizen is determined not to have standing to challenge an election result; and if a group of citizens represented by their interest in a state, any state, is also denied standing to challenge an election result; then who can constitutionally challenge an election, any election, that is mired in controversy and demonstrable evidence of fraud?
From the Alliance:
– An individual voter does not have standing to sue for election misconduct. (He/she is only one person and everyone cannot sue all the time for all elections.)
– An official who may be adversely affected, cannot sue before an election in anticipation of bad conduct because it is speculative (not ripe)
– An official who was adversely affected, cannot sue after an election claiming bad conduct because it is too late (latches)
– A state does not have standing to sue on behalf of its citizens to remedy other states’ bad election conduct (no standing)
My untutored mind is having difficulty figuring out just who, and under what circumstances, has a legal right to a fair election.
It seems the current answer is: no-one.

None of this is new to lawyers. Their job was to frame the complaint with knowledge of the constitution such that the Supreme Court is forced to consider the case. The argument that the complainant had not demonstrated their right to complain about elections in another state would seems fair but they argue the constitution does not support their right to complain about elections in another states. You could say the Supreme Court is signalling that the action needs to be more focused with a really compelling argument for mandatory intervention founded in the Constitution. Given that the complaint was so explosive, the older judges of the Supreme Court ducked and the three Trump appointees did not even comment. They ducked. Now the plaintiffs know what to do, argue standing, necessity, obligation using precise Constitutional references and precedents.
The plaintiffs need Constitutional experts to quickly reframe the action so that it has standing, probably in the parts of the Constitution which deal with resolving disputes between the members States which is the exclusive realm of the Supreme Court.
The core complaint must be about the unfairness and even illegality of contributing to a national election where which four or more states engage in fraudulent voting which obviously affects the rights of other states. A Constitutional expert, exactly like those sitting in the Supreme Court, would know how to do this. And which implied threats, short of succession, might guarantee a response. Otherwise clearly the Court is going to take the easy path rather than be center of a massive controversy.
There have only been three Contingent elections in 1801, 1825 and 1837. It must be presented as the only fair way to resolve an unfair election with widespread corruption of new computer collation of votes, even overseas. The collation of votes has been allowed to be automated in the US with seemingly little legal oversight and has clearly defeated the time honored system of observers. As has been written, compilation of votes over the internet by computer servers in Serbia and Germany is beyond belief. The Court appears to be miles behind the times in making sure the US Presidential election is beyond interference. Two hundred years of tradition are worth nothing in an internet world and the Supreme Court appears not to have noticed.
The way in which this election has been conducted electronically must be addressed in those provision which must promise a free and fair election to National office. And whether the appropriate approvals have been given for radically changing the method of vote collection and collation, especially with the mail in voting.
It should be argued that a Contingent election is the only clean and fast remedy for an unprecedented election widely perceived to be corrupted by electronic interference not considered in the Constitution or previous elections.

I mean the Supreme Court might be shocked to learn that American votes were transported out of the United States to countries on the other side of the world where the Constitution does not reach or American authority of any sort. This may well be illegal in principle as it must have been implied in the Constitution that a National Election was conducted in America by Americans with some provision for Americans who are overseas but not to send the votes of Americans to Serbia!
Surely a theme through the US Constitution is that the election in each US state has people in each US state voting and those votes being handled by people in those same states and reported to Washington.
Who could have dreamed that domestic votes would go to commercial enterprises overseas? I would ask for the election to be invalidated by this fact. And you can be sure that no one has Supreme Court approval to take the American election outside America for tallying. The Founding Fathers would be aghast for their votes to be counted in London or France or Serbia.
Consider that US Presidential election is totally invalid because it was not valid in the first place, regardless of cheating or foreign interference. It is invalidated by the fact that the votes of US citizens were taken overseas to be compiled by unknown people and their computers in another country. (You could also ask the simple question as to why this was done if not for the purpose of tampering.) You can be sure that while it is unlikely anything in the US Constitution explicitly prohibits this, it is clearly beyond the dreams of the founders more than two centuries ago but they would not have allowed it. It should not be allowed today, for a thousand obvious reasons. Commerce and communications can leave the county, not votes. And how this came to happen needs to be investigated. And who was behind introducing computer collation of votes, something which was not necessary before this century and therefore not necessary today.
The plaintiffs must demand a Contingent Election as the only remedy for an illegally conducted election and it is illegal simply because it is not approved. The Founding Fathers did allow for quick resolution of a contested popular election. Then there would be no question of interference.

Yes, FDR had a history of being soft on communism. The New Deal was basically socialism and his VP, Henry Wallace, was an avowed socialist. Less well known was his aiding and abetting Mao, through his rigid anti-Japan hardline stance. He was either a complete fool or in collusion when it came to socialism.

Interesting that the allegations of “fraud” floated so far by Trump and supporters all seem to be just that…allegations.
Allegations that such and such might have been able to happen…and where there have been allegations that such and such DID happen (like the ballots/suitcases/tables thing) those allegations have been well answered, as they should be.
Courts seem to be taking the attitude that just because its possible something could have happened that isn’t justification for widespread disenfranchising of voters. Bring on specific instances, prove that they occurred and mean what you think they do, or dont waste peoples time.

No. It’s just part of a well-prepared plan. If Joe won’t go, Pelosi has already looked into constitutional matters of how to ‘retire’ a health-impeded President. This was announced publicly pre-election. Joe’s position is precarious on two levels; his health, and by being alleged to be the ‘Big Man’ in the Hunter Biden reports.
Even Joe knows the game is up. He probably just ever wanted the title POTUS before he moved on. He served a purpose in the election to cover for the unelectable Harris. I believe if he becomes POTUS and was found to be criminally culpable in the alleged Hunter matter, he will never see the inside of a gaol. As a POTUS, he would be given a pardon by his successor, as the US would never want a history of a POTUS going to prison.

Here are the last four paragraphs of three comments I made on another site:
My solution for the present is that the Supreme Court or congress or both should call for a new presidential election in those four states. This would of course be off-script constitutionally, and difficult to organize in time, especially given the pandemic. But it’s what I think the Founders would call for, were they here now, because it is TRULY statesmanlike. I.e., it would be acceptable to both sides and would not leave whoever wins tainted with illegitimacy.
My solution for the future is that the US should mandate, by a constitutional amendment, ranked-choice-voting in federal elections. If we had had that option this year, neither of the two leading candidates, both extremists, would have won a majority of the votes, and so a middle-of-the road candidate (put up hopefully by a reformed Reform party) would have won in the second round.

If evidence of cheating is assembled soon and looks convincing, GOP politicians and notables could “pay back” the “winners” by pledging to boycott the Inauguration, state-of-the-union addresses, and other presidential appearances, to highlight the winner’s illegitimacy. If this pledging starts now, it might influence the Supreme Court in the upcoming cases (on substance, not procedure), that it will be ruling on. That’s unlikely; but such boycotting could be a very powerful weapon in other ways—and could be a means of letting off steam short of violence.

PS: Another way to avoid violence would be for a large group of state legislatures to declare their opinion that the election result is illegitimate. This would at a minimum induce the new administration to tread cautiously. And it would deter future blatant cheating. And it would get YouTube to undo its censorship of this issue. Biden is merely corrupt so beholden to controlling entities like big business and foreign governments (some of which would wish for extremist policies).
Trump is more center right than anything else by my reckoning and is a constitutionalist to boot.
The true extremist is Kamala Harris who will take over as unelected president once Biden is either forced to resign due to Hunter’s indiscretions being fully revealed or is declared unfit for the role under amendment 25 of the constitution.
