Pennsylvania Case Heads To Supreme Court: Were the votes unlawful?

It appears the Trump team have finally got a case through to the Supreme Court  (known also as SCOTUS). News of this is minimal, indeed practically skeletal. Biden supporters (sometimes called “the media”) may not want to mention anything that isn’t a Trump loss. And everyone else is not sure if the deadline matters. The Supreme Court has given people til Dec 9 to respond, but the electoral college has a “safe harbor” deadline of Dec 8. Sidney Powell says with fraud cases the deadline doesn’t matter. But this doesn’t look like a fraud case. Here’s the  Supreme Court docket which has a link to the Amicus Brief Document.

Perhaps this will matter?

One America News Network  I gather Senator Kelly is challenging Act 77 and whether mail in ballots are legal or even unconstitutional. There’s some excitement on twitter, but barely a mention elsewhere.

Does the date December 9 make it a moot point? William Jacobson, Legal Insurrection thinks maybe not.

More likely, Alito’s action means he and some other Justices take the matter seriously, and plan to rule on the merits once the opposition is submitted.

There is a lot of chatter that such a long period of time, under the circumstances, must be a way for Alito to let the application die on the vine, that the application would be “moot” or otherwise pushing it off to make meaningful relief impossible. Certainly, we can’t read Alito’s mind, but if there’s anyone on SCOTUS I don’t worry about playing such games, it’s Alito (and Thomas, too early to tell for Gorsuch, Kavanaugh, or Barrett).

In my mind-reading exercise, Alito giving the respondents’ enough time to fully prepare opposition likely means he and some other Justices take the matter seriously, and plan to rule on the merits once the opposition is submitted, rather than limiting their ruling to emergency injunctive relief. They could treat the Emergency Application as a Petition for Certiorari, accept it, and rule substantively. The few days gives the Justice enough time to prepare their respective opinions — it’s not like they really need briefs from the respondents to know the counter-arguments.

    Any institution that is politicized will see its nominal function recede and its
    political function expand, public schools, post office, FBI, you name it.
    Politics assigns benefit based on fealty and loyalty. and disciplines through ostracism and exclusion, and eventually punishment.
    None of these include rewards for performing the nominal function of the organization well.

    We have passed to the unreformable: less is better. Some agencies need elimination.

      US and Australia have one thing in common that begets big Federal government. They both have dedicated locations for the industry of government. Washington DC in the US and Canberra in Australia. Both these locations, as voting blocks, massively favour socialist government. The entire income of these locations is sourced from outside the city. They produce nothing of value and yet they are growing in size.

      These locations breed people who know nothing but taking from others for their own benefit. Regional representatives who enter this bubble of contempt for producers soon become tainted and part of the mechanism of extracting from others for their own benefit.

      I cannot see a way to fix this. It is not fixed by limiting tenure because the culture is pervasive. Maybe cutting off power supply for a few weeks in the middle of winter each year would give them a dose of much needed reality. Things that are taken for granted before might get more deeper reflection.

    The FBI. & the DOJ. have been caught with “their hands in the cooky jar”! (Post Nov. 3 esp.)
    Hopefully the 5 non-left Supreme Court judges &/or the Electoral College hold their nerve & show they still have some “Kahunas” in the next 9 days?
    If this ’20 Election Fraud is not corrected the US. will be left paying the high price of fixing up many of the irresponsible far left Dem. regressive-progressive reforms for most of this decade!
    (The Paris-ite Agreement will also take more years to un-do if the Georgia run-offs also goes south next month.)
    My heart says we hopefully will see a 2nd Trump term, but my head (& 1/2 my super in cash/not shares) says we probably will see a Biden/Harris term instead! 🙁

      I don’t know if there is any event that you are specifically referring to.

      What I remember is that old post boxes were being decommissioned and somebody photographed a yard full of post boxes. The media and the Dem’s went nuts with accusations.

      But this was a standard function of the post office. Boxes that don’t get much clientele get removed or relocated, other boxes get old or damaged and get replaced.

      This was a beat up all about nothing.

    This is an important step in the process. All that Trump needs to do is now establish that there was a massive coordinated interference into the 2020 US election and the DOJ and FBI did not respond. I have a ‘feeling’ that the 2020 US election controversy is not over and is tied to other stuff. Something appears to be happening in the US.

I also heard that Trump is at arm’s length to the Milt investigation and that the Milt is not releasing any info from the investigation, until they determine what should be done based on their investigation.

      Hi William…..the key to what is going to happen in the USA is Trump’s 2018 Executive Order which describes who will be subjected to having all their assets seized by the United States government — and note that this applies to corporations, individuals, partnerships and even non-profits: (emphasis added)

It is important for Americans to understand that these destructive changes to our election laws were NOT a necessary response to the pandemic.           Yes, I’ve been watching the EO material for a week or two and seems that the moves to change staff at the Pentagon suggest there may be something to it. We hope things get resolved in the Supreme Court. But sadly I don’t think the current case will achieve the sense for Dem voters (the ones who are not religious ideologues) that there was a fair win for Trump. There really needs to be a win on a fraud case for that.

        That Executive Order has been ignored by the Enemedia but as you say, it could be the key.

        And you have to wonder why Trump wrote it in the first place. He would only have done so if he had solid intelligence that this had already happened or was going to happen for the mid-terms (which this was written before) or the last election (2020).

        More than likely, both elections of Obama were highly fraudulent as well, not even considering the fact that he was possibly not even a natural US born citizen.

        Also, the 2016 election was likely highly fraudulent in favour of Killary as well but Trump still managed to win it with numbers that exceeded the fraudulent votes. The Left weren’t going to let that happen again in 2020.

The Trump team are still raking in millions of dollars (USD!70 million the last figure I saw) so motive, means and opportunity all thicked.               US politics is the Swamp and not just inside th Washington beltway. That this election can so easily be called out as fraudulent and believed by so many people says what really needs to be said about the shambolic US electoral system and constituional arrangements.

    Justice Alito is more than on the ball. He knows exactly what is going on.

    It’s Roberts we have to worry about. He is, by many, many reports, compromised in some manner, even though he began as a strict constitutionalist. But he has been voting with the Left-wing bloc of the court for some time now and is NOT to be trusted to do the right thing.

    The Pennsylvania issue is massively important as it may well set the court’s tone for any other case brought before it in the same vein.

    We will have to wait and see, but Rudy and team have a bullet-proof case. Does not mean they will win.

    But if they don’t start looking for hints of that EO being put forward….

          Thanks Ross P. Just found this: This is dead simple. Justice Roberts has two adopted children. There were some shenanigans getting the adoption paper work done. The threat against him is not actually against him but against his adopted daughters that could be deported which would also devastate his wife and him. So, yes, Obama is blackmailing him with deporting his daughters. Pure Alinsky – can’t attack the man so attack his family and a strong family commitment then becomes his achille’s heel. Keep in mind how the Obama administration handles deportations. They enforce the law selectively. Illegal immigrant rapists and murders are let loose on the streets but cross them and your adopted children will be deported.This is all documented. I saw an article somewhere some time after the first Obamacare decision that was butchered by Roberts about his adopted children. Do the research. It’s there. But it was a back page little blurb that could have been blown up into a national scandal and possibly have removed Roberts from the bench. But nothing came of it. Why? Because they knew they would need it again later. Now apply this to Boehner, McConnell, military leaders, anyone at all that gets in the way. Make them an offer they can’t refuse.

          I think “This is all documented. I saw an article somewhere sometime…” is my favorite attribution ever. And the same Supreme Court just ruled that there is a constitutional right to same-sex marriage.

      I reckon you are spot on Alito knows exactly what is going on, from early on.
      Trumps rally in GA today shows he is commanding the theatre of public opinion.

      That Roberts is on the list linked with a certain island and private transport is stated as fact. Information supporting it is readily found online.

      So thinking on how he will act depends on how far down the rabbit hole one has gone.
      As in which list and what does it mean.
      There are a lot of curious coincidences playing out lately, like its the game of crowns.
      The EO is doing its thing in a parallel theatre, nothing disproves it is not going on.

    Terms like “regressive-progressive reforms” say so much about what needs fixing.

    For me, nothing illustrates that description better than the abandoned wind turbine region in the U.S. where 14,000 old turbines stand ignored and rotting.

    After the usual token renewable service they sit on an immense area of land with the beneficiaries of the scheme being released from any obligation to decomission them. They’re a danger, an eyesore, and an environmental disaster.

    The point is that Politicians created this mess for personal gain and that must be acknowledged and fixed.

    O’Biden won’t fix it nor will he be interested in the other societal disasters that need sorting.

        Built to withstand hurricane winds, the turbine blades cannot easily be crushed or recycled. About 8,000 of the blades are decommissioned in the U.S. every year.

        Once they reach the end of their useful life on electricity-generating wind turbines, the blades have to be hacked up with industrial saws into pieces small enough to fit on a flat-bed trailer and hauled to a landfill that accepts them.

        So currently about 8,000 per year. The number will grow in line with the growing rate of installation. Although I think the rate of new turbines is in decline now.

          According to my research wind turbines, even when subsidised with Paris Gold supplied by taxpayers/consumers, once they reach their effective working life the cost of dismantling, recycling and dumping well exceeds the costs involved in preparing the site for replacement wind turbines and commissioning exceed shareholder’s dividend profits over the plus or minus 20 year period that the installations provide.

          I strongly suspect that major shareholders intend to sell their shareholdings a few years before replacement becomes necessary.

          There are examples already.

            There is a major problem with the replacing of wind turbines.

            Those older wind plants now reaching time expiry (15 years onwards) have older turbines, all of them usually lower than 2MW. These older ones have those smaller generators in nacelles atop the set height structure tower for that generator. That tower height is set by the generator size, and the blade size required to make that generator turn over, and the height and strength of the tower so those blades have the required legislated ground clearance.

            ALL of those newer structures now have larger generators. These now need stronger and longer blades to turn them over. and with longer blades you need taller and stronger towers.

            So, replacement of those turbines now time expired is not a case of ‘plonking’ a new larger generator on top of the ‘pole’ but a complete new tower, hence the destruction of the older tower, blades nacelle, everything.

                Yes, vibration causes fatigue failure and when you assess the design of the wind turbines it’s a certainty that they were design to fail early.

                The only things that wind turbines do is produce money for the Elite “Investors” , Kudos and green points for the politicians who endorsed the “scheme” and financial fleecing of the taxpayers who not only pay to build these monstrosities but are left with the cleanup when companies fold.

                When you can have 4950 wind turbines in one farm it’s not surprising that the nation’s tally could be 14,000.

                This is World War 3. The elites who previously pitted country against country have decided that there’s more profit in banding together against the plebs and skimming them. Regular meetings at the United nations, WHO and WEF help coordinate the process.

                Europe is stuffed, as is the formerly Great Britain and closer to home we have Victoria Queensland and Western Australia all testing the capacity of plebs to absorb punishment.

                The only visible hope was Trump and we’re getting close to the finish line there.

              Presumably the upgrade to the tower (i.e. replacement) for the bigger generator/blades will also mean a larger, stronger concrete base and rather than go to the expense of taking out the old one they will just build (dig in) a new one alongside. It just gets worse.

    Is There Another Scenario That Makes Justice Alito’s Dec. 9 Response Date Meaningful in Different Way?

    In my story yesterday I noted that the due date for the opposition papers is one day after the last day on which the Pennsylvania electors could be named based on the election results as certified by the Secretary of the Commonwealth and that there is currently no court order which prevents that from happening. As some have noted, the end of the “safe harbor” period — December 8 — is simply a date established by Congress by which a state benefits if all election disputes are settled and the outcome is certified by the state at least six days prior to the meeting of the Electoral College. The states are not required to meet this deadline, it only provides that certain challenges to a state’s naming of electors will not be entertained if the state does meet the deadline.

    What many have correctly noted is that this “safe harbor” provision has no legal effect on what the Supreme Court can do if it were to find merit in any election challenge it chooses to hear. Until the Electoral College actually meets and votes, the Court possesses the authority to issue an injunction preventing the electors from any particular state from being able to lawfully participate on the basis that the manner of their selection was legally invalid.

    In recent years, in violation of the law, the CIA has spied on American citizens, undertaken domestic acts outside of its purview, and operated a rogue agency. Under the direction of John Brennan, as deep a swamp creature as has ever existed, the CIA engaged in long-term illegal operations against the Trump campaign and, even after Brennan, carried it over to the Trump Administration.

    Time will tell if the CIA was involved in manipulating the 2020 election. CIA servers positioned in Germany may have received election data which was then recalibrated in some way and sent back to the US. Why does this relay even exist?

    A Strong Drift off Course

    The CIA is supposed to consist of dedicated personnel who watch out for the welfare of American citizens and American interests around the globe. Gina Haspel, the first female director, has intentionally slow-walked legitimate Freedom of Information requests and knowingly impeded lawful investigations into agency activities.

    Presumably, Haspel is maintaining some sort of loyalty to staff and peers, but this is not part of her job description. She needs to be loyal to the president, the country, and her oath of office. Haspel should be fired and walked out of her office immediately, with all files, computers, and records kept out of her reach forevermore, as a thorough investigation takes place as to why she has resisted.

      It is interesting that the President appointed Christopher Miller, two days after the US 2020 election to lead the Pentagon for this very important period.

      Miller was the Director of the National Counterterrorism Center.

      If there was interference into the US election by a foreign power and the CIA/FBI were involved in a cover it up, Miller would know at the highest level and what communication should have been sent.

      Miller also is the right guy if there will be highly sensitive operations with risk of low-intensity conflict and if foreign internal defence is required.

    But there are small portions where he mentions the difficulties that came to exist due to the “trade war” launched by Pres. Trump after the 2016 election. He references the fact that prior to Pres. Trump’s election, China had “friends” among the Wall Street elite, the true political and economic elite of the US who was able to step in and “fix” problems between the two countries as they arose from time to time. But he states that Wall Street was not able to “fix” President Trump. He claims that friends on Wall Street told him they tried to “fix” President Trump but were unable to do so because of his past contentious relationship with Wall Street — seemingly making reference to Trump’s history of litigation with creditors of Trump Inc.

    After mentioning the difficulties encountered in getting Wall Street to “fix” Pres. Trump and the “trade war,” the speaker then goes on to talk about how they are happy that Biden will be President:

    I’m going to substitute “bribe” for “fix” in the translation supplied by Ms. Zeng. I’m sure her translation is correct, but in context, it seems clear to me that the speaker is making reference to a basic principle of Chinese statecraft — you get political accommodations from rival foreign governments by making it financially beneficial to the leaders personally to act in the manner in which you are asking them to act.

    They have already laid that foundation with Biden and his family, and they now expect that relationship to payoff by “resolving” conflicts between the countries in ways that were not possible while Pres. Trump advanced a political agenda that put US domestic interests ahead of the interests of global rivals who also happened to be trading partners.

    China is a malevolent force in the world, and their overriding consideration behind all political and economic policy decisions is advancing on the goal of displacing the United States as the preeminent military and economic power in the world.

    In the last weeks of the presidential campaign, Donald Trump was drawing tens of thousands of enthusiastic supporters several times a day, and people across the land, and at sea, formed massive rallies and caravans of their own. Meanwhile, the Biden camp was barely limping along, with one or two funereal gatherings a week, before, at best, a few dozen people (sometimes, overwhelmingly outnumbered by Trump supporters); the campaign’s apparent strategy was to minimize the candidate’s exposure (and let the media do the work for them) — not only because the candidate was feeble and the campaign advocated lockdowns, but also because evidence began emerging of the Biden family’s dealings with foreign oligarchs and corrupt countries — most importantly, Communist China.

    So, as election day approached, things were looking good for the president. Indeed, as the results came in on election night, the president was headed for re-election. He was ahead in the electoral college, and had big leads in the handful of remaining states he needed to win.

    Then, suddenly, the counting stopped. Late at night, five decisive states announced at the same time that they stopped counting. Has the counting of votes ever stopped on election night in any election, let alone a presidential election? It’s as if, with a couple of minutes left to play in a basketball game, one team is way ahead and “running away with it,” and the other team is down and dejected, staring defeat in the face; and all of a sudden, the referees stop the game for the first time ever, and for no stated reason. Then they send the team that’s winning, home, blindfold them, and tie their hands; leave the trailing team on the court by itself, with control of the scoreboard and the keys; and ask them to send in the final score, whenever they want. If there were fans in the stands, they’d yell, “How much they payin’ you, ref?”

    I’m a Legislator in Pennsylvania, and I’m Suing the Governor for Election Fraud

    Many members of the General Assembly, of which I am a member recently re-elected in a landslide, believe that the mail-in ballot process in the Commonwealth of Pennsylvania in the 2020 general election to be so defective as to declare the selection of presidential electors in this commonwealth to be in dispute. To this end, many of my colleagues and I have petitioned the Congress of the United States to declare the process of mail-in ballots so flawed that the Congress of the United States, as prescribed by the U. S. Constitution, should select Pennsylvania’s electors for the 2020 general election.

    Further, we believe that a special prosecutor must be appointed to ensure that this conduct is dealt with legally and all nefarious behavior condemned. Going forward, it is clear that election reforms are needed, voter ID is essential, and mail-in ballot security must be an essential element of any election reform to ensure we do not have a repeat of 2020.

    The liberties of our citizens cannot be squandered to incompetence, fraud, or tyranny to satisfy an artificial timeline. Liberty is timeless.

    It has been over one month since the November 3, 2020 election.

    Trump, and supporters of Trump, have not won a single state court case.

    It’s almost over for Trump if the goal is to prevent Biden from getting 270 electoral votes on December 14, just nine days away here in the USA, maybe eight days in Australia?

    The next step is to change the voting methodology in Georgia this month, and that has not happened yet

    Over one million absentee ballots have been requested and the haphazard signature checking is an invitation to voting fraud.

    Democrats could win both seats in Georgia with enough fraud.

    They’ll probably win one seat with the normal amount of fraud.

    With turncoats like Mitt Romney in the Senate for Republicans, winning one more senate seat might be good enough for Democrats controlling the Senate, at least on on some votes.

    I think what people need to understand is the process.

    Step 1, explain to the people fraud has taken place

    Step 2, slowly release the evidence, some people already accept the fraud but others will take longer to accept.

    Step 3, start arresting the guilty.

    Many people are starting to wake, they see the media blocking the flow of information, Twitter, Facebook and Gmail are blocking discussion.

    People see the MSM refusing to cover the issue.

    I saw a tweet of the georgia video showing the woman run the same ballots through the counter 3 times and I don’t use Twitter.

    People know the usual trump bashers Obama, Clinton, MSM are extremely quiet, they also notice Biden has not stated he supports trumps endeavour to show the election was fair….all they see is silence.

    They have hinted dominion played a role with China and Iran manipulating votes with just enough evidence to whet people’s appetites.

    Soon most of the people will accept there was fraud, 12 days from now will trigger the EO, when the arrests begin people will now understand why and be far more accepting of it, the MSM will report their now obligatory fakes news but by then virtually no one will be listening to them.

    It is argued that in election fraud, the evidence is held by the state and can’t be acquired by the complainant without an order of the court. For the court to dismiss a complaint for lack of evidence is corrupt.

    Can’t say I have seen any signs of the MSM mediocracy “waking up”. Still wondering what it will take…. More likely to see martial law than MSM waking up.

    2,506 felons illegally voted
    66,248 under 18 registered to vote
    2,423 weren’t registered at all
    1,043 used a PO Box
    4,926 voted past the registration date
    10,315 died before the election
    395 voted in two states
    15,700 moved out of state before the election
    40,279 changed county and didn’t re-register to vote

    With a margin of only 11,000 votes they have no idea who won.

      I was pleased to see Team Trump’s lawyer gave these figures in a recent hearing. ( I had originally seen them on a copied tweet a week or so ago). The fact the lawyer had those figures suggests that they have checked their veracity , assuming Team Trump was not the original source.
      They really only have to check the under aged 18 registered to and see if they voted. Assuming only half voted it is still plenty and it reasonable to assume most if not all would go to Biden.

    Louis DeJoy was not “hand picked” by Trump.

    He was unanimously selected by the Board of Governors of the United States Postal Service. This board is required by law to comprise of a mix of political parties and there are currently two Democrats on the board.

    It wasn’t entirely an arbitrary selection, DeJoy was CEO of New Breed Logistics, which had been working as a logistics supplier to the USPO for a few decades. He had built up his father’s trucking company and demonstrated great ability when it came to efficiency. He was also somewhat anti-union and a long time Republican donor so that might have helped … but the Democrats on the board of governors decided to support him.

    My vote for Libertarian Gary Johnson was not counted. The local Texas official said it missed a deadline of one month before election day. This year, again in Brazil, the Consulate didn’t even send me the ballot I ordered, but I was able to make small contributions. The Libertarian party siphons off votes so that the kleptocracy candidates most unlike us tends to lose. In this case it was the GOP slate, which did not change its 2016 platform. The Dem platform promised not to cage people solely because of taste in drugs. It also kept the original LP position that women ought not be forced into involuntary reproduction for the first 100 days. I recall 4 years ago the unelected threw similar tantrums. To Libertarian voters, what matters is that our votes make them repeal bad laws.
