In a democracy the Court of Public Opinion is (still) the highest court
Donald Trump’s name can stay on the ballots.
It’s one of those rare moments in 2024 when something makes sense. All nine justices of the US Supreme Court have decided that the largest jury in the world should be allowed to judge for themselves who they want to have as President.
The Colorado Supreme Court had decided that Donald Trump was too naughty for people to vote for, even though he hadn’t been charged or convicted of leading an insurrection of horned people (or any one else) to overthrow the US government. The votes of a few state officials would therefore overrule the votes of millions potentially. And the whole idea of being innocent until proven guilty was tossed out the window.
The Court of Public Opinion is the only one that matters in a democracy. If there was free speech and a free media, crimes will be investigated, and the evidence put on display
As The Epoch Times said — it has never happened like this before:
The [Colorado Supreme] court’s decision is also “the first time in the history of the United States that the judiciary has prevented voters from casting ballots for the leading major-party presidential candidate,” his lawyers said, concluding that it “is not and cannot be correct.”
Justice Clarence Thomas has an excellent question:
Justice Clarence Thomas asked the lawyer, Jason Murray, why there weren’t many examples of individual states’ disqualifying candidates under the 14th Amendment after the Civil War.
“There were a plethora of confederates still around, there were any number of people who would continue to either run for state offices or national offices, so it would seem—that would suggest there would at least be a few examples of national candidates being disqualified,” Justice Thomas, a Bush appointee, said. — Reported by ZeroHedge
Why indeed? If starting a civil war doesn’t count as an insurrection… what does?

It is so good to see that some justice, or is it just common sense, still exists in the United States. Trump will easily win the Republican nomination and he will easily win the popular vote in November but that does not guarantee he will win the Presidency. Don’t forget he romped in last time and still lost. There are so many of the rich and famous as well as the bureaucratic powerful who stand to lose everything when a new well informed Trump takes the reins. Like most normal people he assumed he was in charge last time but did not realise he was surrounded by enemies pretending to be on his team, Bill Barr for one. Hopefully his Secret Service minders will keep him safe and his voters will overwhelm the duplicity of the Democrats and RINOs.

Thousands of witnesses to voter fraud not given an evidentiary hearing…..

None failed. The courts refused to hear them, allegedly no standing. So don’t write cr@p.

Simon, those numbers are just as fake as BoM’s and other climate agencies figures to “prove” supposed anthropogenic global warming.
If the votes were fraudulent in the first place the numbers that prove the present White House Resident’s “election” are also invalid.
871
Given that the establishment and media are running a protection on the current President and his son, whilst pursuing Trump since the liberal left under Hilary Clinton lost. It takes a thick hide but Trump is the best hope for the US.
590
No evidence for the ‘fake’ votes, Trump has had 4 years to look, more recounts will find them ?
316
Masses of evidence, just refusal to be heard.
201
The problem with 2020 USA election results may or may not have been “fake votes”. The real problem is that many of the laws and regulations regarding voting procedures were ignored to the point where it became impossible to audit the voting (NB: don’t ignore verification of the voting registration lists). Sadly that seems to have been the case more in urban areas than rural.
Thus it is not possible to truthfully say votes were fake, however likely that condition may be.
110
Not really….. the deafening lack of evidence after all the efforts to ‘find’ it leads to the conclusion that the results were correct, as voiced by the electoral commission.
218
Really?? You are that ignorant and ill-informed that you have not heard of the film 2000 Mules? Not heard of voters allegedly well into their 100s still voting? A ‘student’ in a college dorm voting for 20 years? Voter rolls have 50% more people than the population of the state? Voters ‘living’ in factories and offices or at addresses that do not exist? DemoTwats luring legal Republican observers out of count rooms and then locking them out an boarding the windows? Vans arriving late at night to unload ballot papers? Ballots being run through count machines multiple times? Voting machines that should not be connected to internet were? That it was demonstrated in a court that a Dominion voting machine was hacked with a pen inside 5 minutes and that votes could then be changed and the hacker can wipe out all trace of having been there? And we now have the film Let My People Go that looks at all of this but obviously this will pass you by as well so you can preserve your ignorance.
171
One of the states in the last week confirmed there were 150,000 more votes than on the role and you want to claim no evidence of fraud or fake votes.
30
The Dems know that Biden cannot win against the Trump juggernaut, so who should replace him? Perhaps they should pick a clean skin.
Assuming the Republicans win I see Donald bringing back Schedule F, which should bring an end to global warming hysteria.

Michael Obama is the most favoured by Democrat voters.

I guess the first gay US President didn’t want to expose his boyfriend too much in case questions were asked. If Michael stood for president the scrutiny would be massive.

Most Americans think they’ll vote Biden out of office this year but forget the fact that he was never legitimately voted INTO office.

Bit Simon… the LNP gets the popular vote to majority of the time.

The USA’s constitution is a brilliant document, recgnising as it does that it is the people who should have the final say. Would that other countries had as strong a foundation for democracy.
As an aside, if the Tory party in the UK had a democratic process for election of party leader then Rishi Sunak would not be PM.
200
It’s about time that the left wing extremists threw in the towel and let the Republican voters choose their preferred candidate.
And any Republican would be a better leader than Biden when they vote in the November 2024 election.
390
Fantastic news. But I hope The Trump Campaign doesn’t have to go to the USSC to contest every single case of name removal by the various states.
I hope this is seen as a blanket ruling.
And while it waa a pleasant surprise this being a unanimous decision, Judge Clarence Thomas is about the only solid, reliable, conservative, pro-Constitution judge on the USSC. The Left hate him because he is a black conservative. They think he should be enslaved as a welfare-dependent DemocRAT voter given that plantation slavery is now illegal (you will recall that the Democrats supported slavery back in the day, Republicans opposed it).
641
‘Judge Clarence Thomas’
The Evil empire knows the Constitution is strong in that one.
282
This is a case of the individual states trying to legally restrict a Federal election where they have no authority to do so. It’s not for them to decide who can run for President.
And that based on their extremely biased interpretation of events in Washington, DC, outside their jurisdiction. Their laws stop at their borders. New York is doing it differently by trying to wipe out Donald Trump financially and if possible put him in jail. Just like any third world dictatorship, say Ukraine, Pakistan, Brazil, Malaysia, Myanmar. You jail an ex-President to prevent them contesting the election.
Trump in his first term was nobbled by Paul Ryan in the Senate and like Australia, RINOs in the congress. But he at least managed to appoint conservative judges. And by conservative I mean people who actually read the law, not misread it. Roe vs Wade was an abomination of a decision. The Federal Supreme Court made a ruling on State exclusive health matters. That’s not bias or conservatism. Their ruling was clearly wrong.
I believe the Federal government in Australia is pushing law after law through parliament without oversight, possibly by either party. Canberra is out of control. And we have no journalists.
521
TdeF,
There are several recommended journalists writing for Quadrant and Spectator.
Tony Thomas, for example, maintains journalistic quality by researching and referencing many or most of his contentions. Robert Clancy speaks to his experience on medical matters like Covid. Quadrant On line is on my daily reading list because of its quest for truth. Geoff S

Thanks. He writes very well and professionally with references.
I have met Tony in a number of talks. One I gave to the Turks Head Club. And others at the Book Cellar club, both two talks I gave and recently with John Howard as speaker on his new book and Alan Finkel with his book.
I am disappointed in these public figures as they are inflexible. John Howard says he is ‘agnostic’ on Climate, which suprised me. Just as it is amazing the way the Liberals concede on the idea of man made CO2, let alone CO2 driven warming and the total destruction of coal based power. Also he defends the appalling Renewable Energy(electricity) 2001 Act which is still an ongoing massive carbon dioxide tax posing as Green Certificates to bypass the law.
140
TdeF. Thanks for all of your brilliant comments. Paul Ryan was the Speaker of the House. Mitch McConnell was Leader in the Senate. 😉

Democrats supported slavery and the ALP supported the White Australia Policy. Was it Arthur Caldwell who said that Two Wongs don’t make a white?

ALP socialists supported “race purity” in 1949 just like their comrade National Socialists in Germany a few years before.

The simplest “solution” for Colorado’s legislature is to print the ballots however they wish to see them and ignore the USSC.
What would be the penalty? Forcing the election to be considered invalid?
40
Colorado has 10 electoral votes. [Only 9 in 2020]
The 9 votes when to Biden in 2020.
It would be foolish to ignore the ruling and forfeit 10.
80
Unless it was then ruled the entire election was invalid….
10
Don’t forget who chaired the “high tech lynching” of Clarence Thomas back when he was nominated for the Supreme Court.
None other than then-Senator Joseph R. Biden. The Democrats have never liked a black man who didn’t know his place on the plantation, and Biden is a true Democrat.
270
Right on!
160
In 1948 Congress decided who could and couldn’t become elected to office under USC 2383 Rebellion or Insurrection – in keeping with their sole lawful authority under the 14th Amendment.
Colorado, Indiana and Maine have all grossly over-reached their limited authority in trying to ban Trump from the 2024 election.
These State Judges / Sec’s of State have failed to uphold the Constitution of the United States (an oath they have all taken) and their impeachment for misdemeanors should now be forthcoming.
Republicans must make it hurt – or Democrats will try again!
490
The Supreme Court unanimously agreed that defining who and who is not an ‘insurrectionalist’ is a Federal not a State decision. The Trump insurrection court case is yet to come, but the conservative Justices seem to believe that this is a decision to be made by Congress.

Trump never called for insurrection. Case closed.

How does insurrection work without any weapons at all? What chance insurrection when those protecting the Capitol were armed? The only murdered person was a woman, a double tour Iraq veteran shot point blank by a policeman. But the public were fed stories that three people had met a violent end. This was a continuing and deliberate and manufactured lie, a hoax.
What sort of insurrectionist was he when Jacob Chansely was shown around by multiple policemen and led a prayer for congress and is then jailed for 41 months in jail for violent insurrection? They even hid the video showing that nothing of the kind happened. And when it was released, he was immediately freed.
The whole situation where the building was opened by the police, not locked up, was a political trap. Pelosi, as speaker in charge of the security set it all up. Where things were broken, there were undercover government agents involved.
While Portland, Oregon with months of violent occupation, murder and arson was declared ‘largely peaceful’, a genuine protest was painted as an incredibly violent insurrection.
“More than 1,200 people have been charged with federal crimes relating to the attack. As of December 2023, 728 defendants had pleaded guilty, while another 166 defendants were convicted at trial; a total of 745 defendants have been sentenced.”
161
Simon, you are just repeating Orwellian lies.
Have you done your Two Minutes of Hate yet, today?
Just replace the subject of Two Minutes of Hate from Nineteen Eighty Four, Goldstein, with Trump.

I think it was an Insurrection of the Unvaccinated.

As a Yank I have to agree with this being seen as funny, Honk.

“insurrectionists”
Wrong word. The Colonists never attempted to overthrow George III or the UK’s government.
See my comment @ 12:00pm, #16
30
John Hultquist,
George III was also king in the American colonies. They overthrew his reign there. It’s called the American Revolutionary War for a reason (though also known as the War of Independence, which puts a nicer spin on it).
20
You know that unanimous means that ALL the justices agreed. So don’t pretend this was a republican appointee decision only.
It’s very noteworthy and important that this was unanimous and you shouldn’t try and paint it any other way.
220
There are NO insurrection case coming for him simply because there was never anything established against him during the Joke6 Committe kangaroo court hearings.
LOL

There will not be an Insurrection court case.

How embarrassing, with all those gentle folk convicted of insurrection-related trespass crimes.

What’s old about it?

Big Mike has said he/she/it won’t run but that might be just for the optics. He/she/it will, at the last minute, “reluctantly” run for President and they’ll buy Harris off with a USSC position.

While the court ruling provides a glimmer of sanity in the legal system, it simply doesn’t matter, as it just increases the anti-Trump mouth frothing and ranting from the anti-democracy Demonrats, driving the USA still further into the inevitable collapse.
Fraudulent “close call” poll results suggesting Trump is only just ahead of Biden are laughably detached from the truth. Biden is way way behind.
It doesn’t matter who wins the “election”. You all lose.
Nothing lasts forever, and just like so many corrupt regimes before it throughout history, the USA has had its day, awaiting a rebirth.
The neocons, who call no country home, would raze the USA to the ground to stop Trump. Their raw irrational hatred allows no other path.
Don’t cheer, prepare.

It seems that the so called Neanderthals are correct and the silly Biden donkey is wrong, if you understand the “Kaya identity”.
So how many more TRILLIONS of $ do the Biden donkeys want us to WASTE down the drain to achieve exactly NOTHING?

I only wish the Republicans would use their brains and display the OWI Data graph to show total GLOBAL ENERGY by SOURCE and HIGHLIGHT the near horizontal TOXIC W & S biro lines at the bottom of the graph.
Even the most infantile DEM voter should be able to understand this delusional FRAUD and CON TRICK.
https://ourworldindata.org/grapher/global-primary-energy-share-inc-biomass
120
BTW we should never forget that TOXIC W & S have CAPACITY FACTORS of only 30% (W) and 14.5% (S) across Australia.
Of course TOXIC Solar capacity factor in the rest of the world would be much lower than 14.5% , including all NH countries.

Personally, I think the 2020 US presidential election was obviously fraudulent. I watched it unfold. It wasn’t difficult to see that “the FIX was in”, as they sometimes say.
For that reason, I’m still surprised that anyone can seriously believe the election was legitimate. So, following this line of logic further, it makes me think that those who see Biden as the true President were either too disinterested in politics to even notice what happened in November 2020, or have reasons of their own to overlook reality and support a fiction.
If we accept that the election was tampered with, events in the US since then seem to indicate that nothing concrete has been done to ensure we don’t see a repeat of the fraud later this year. This makes me think the 2024 presidential election probably won’t be allowed to take place unless and until the full extent of the 2020 debacle is brought to light and the voting system overhauled. And I think bringing that assault on democracy to light will drag with it a whole Pandora’s Box of other evils into public view.
Could be a very interesting year.
240
Hot on the results of the 2020 election being posted there was an article that reckoned the first group to realise they had been shafted was the Las Vegas bookies – and that they had long memories
150
I don’t gamble much, but when a friend said he’d bet on Trump I did the same.
I still have the ticket, waiting, waiting for the result to be declared fraudulent.
80
Now that’s funny.
I would put that firmly in the basket of wishful thoughts.
Can you imagine the mess in the USA if Biden was officially declared to have been a fraud?
It is rather amusing how gentlemanly the who process is in the USA. You have the bureaucrats in DC doing everything within legal reach to prevent Trump from having another stint in the office. They have managed to maintain some level of face with Biden mostly concentrating on not soiling his pants.(I admit here that I find Biden hard to watch. He has become a sad figure.). He may go from the office to a retirement home. I doubt he will make big bucks on the talking circuit.
Compare the USA to Russia. Russia does not need all that expensive bureaucracy. Rather they just have a tough nut in power capable of making anyone who questions his authority soil their pants. Mr Putin is truly a great man. Who would argue otherwise?
91
Putin appears in the Tucker Carlson interview to have been a bit ‘miffed’ on behalf of Russia. Having removed the fence and the dogs, his neighbours failed to invite his people over for lunch and instead decided to arm themselves with a missile defence system that would allow the neighbours to hurl any insult they liked without fear of reprisal.
Who knows the truth?
50
Yes.
It seemed obvious that Trump was going to win.
What eventually happened was so obvious that it seemed that the result might be “corrected”.
Sadly lawfare and US political lawlessness prevented a correction so my bet was denied justice.
I’m not happy about that.
100
Interested,
Like you, I was logging the US election 2020 as the results came in, thanks to the USA/Australia time difference. I have kept my notes and and scribbles that I made on the night. The “fix” that you mention was quite clear. The time trends of votes in several ket States changed in a way that had a small to vanishing probability of being natural rather than corrupt.
It really boggles the mind, does it not? How can such an “advanced” country put up with this type of alleged organised crime?

Joe Biden breaks Obama’s record for most votes ever cast for a U.S. presidential candidate
By Sophie Lewis
Updated on: December 7, 2020 / 2:20 PM EST / CBS News
In 2008, Barack Obama earned 69,498,516 votes in the presidential election, the most ever. Now, Mr. Obama’s former vice president, Joe Biden, has far surpassed that tally, setting a new record with more than 81,284,000 votes (51.3% of the total) in the 2020 election.
With voter turnout in record territory, President Donald Trump also exceeded Mr. Obama’s record, with over 74,221,000 votes (46.9%).
Biden more popular than Obama – no way.
220
Because in the USA as in Australia, most of the population are inadequately-educated TV-watching sleepwalkers who are…
100
Trump’s opponents argued that the pattern you describe was just a feature of the vote collecting and counting process – ie, postal votes get counted later, etc. So I looked for the same pattern to emerge in the mid-terms. It didn’t. To me that is a pretty good indication that the 2020 result was fraudulent. Will they be able to prevent a re-run in 2024? Now they know about it, I hope so.

SCOTUS rules on narrow specifics of law.
Otherwise, I see little to no structure in US Government that will tolerate an authentic ‘free and fair’ election that has the possibility of a Trump win.
It is really something what Trump has come to represent.
A global phenom.
Trudeau complains about ‘MAGA’ in Canada.
How many governments are working at this very moment to make it illegal to question science and government?
How much of this is prompted by the imagined threat to authority symbolized by this one man?
210
That pretty well sums up the whole situation, Honk.
Trump is the “last man standing” between a world-wide globalist Leftist dictatorship and freedom.
It really is that simple.
241
Can’t disagree David.
You also have provided the clear reason that the Left is absolutely frantic to put Trump out to pasture.
100
Well, I don’t know if the US will ever get out from under it’s own ignorance.
When you have a justice system that is based on Party, you have no end of trouble, no matter what the blindfolded lady supposedly represents.
It’s accepted there, that decisions by judges will be based on their party, not by the law.
It’s accepted! That’s the trouble. The Judges are even called by the colour of their appointment. A Democrat Judge or a Republican Judge.
Congress congratulates itself on appointing D or R Judges! Stack the Court!
One of the SC Judges lamented the other day that she was distressed by the number of conservative judgements made, with no mention of the law.
I read yesterday that the Judge in the Fani Willis case against Trump, will be very unlikely to censor Willis, because he’s up for election in a few weeks, and he can’t upset his “constituents.” We’ll see with that one later.
You see and read about Judge bias all the time, but you never read or see any Congressman suggest that something should be done about it.
I think it’s a matter to them of win some, lose some, and to hell with any one’s guilt or innocence.
100
I fear that should DJT prevail anarchy will ensue. The DNC Brownshirts, BLM and antifa, are awaiting their recall to “civil disobedience” duty. There will be more than crazed women screaming at the sky.
The one thing dims can’t tolerate is honest democracy

Indeed, those “mostly peaceful” riots come to mind.
100
Is BLM still a thing? It seems to have morphed into drag queen story time.

“If starting a civil war doesn’t count as an insurrection…”
South Carolina and the Federal Government had disagreements. Had the Confederate States been allowed to separate from the Nation there would not have been a war. Thus, the word “insurrection” is not the best word for the “War of Northern Aggression.” 🙂
10
I’ve believed, for at least the last 40 years that the USA population is the most brainwashed on the planet. Far ahead of Russia, China, Nth Korea.
The situation in USA today is all the proof needed!
70
I too, fear that a Trump win will not be allowed to happen. The Dems got away with rigging the election once, why would they not try it again?
50
I draw solace in the thought that, like 2016, they will be caught ill-prepared by the magnitude of the swing and will not be able to smuggle in enough ballots to make up for it.
30
Trump is looking to me like the proverbial steamroller.
I see Jamie Dimon’s declaration that “Trump was kinda right” as carrying a lot of weight.
30
This is just American stuff. Not relevant to us. Regardless of who becomes US president, Australians will get screwed.
411
It’s called masturbation when you’re screwing yourself.

What has America done to you to make you so bitter?

RoHa, I think I get your sense of humor.
The rest might catch up.

When next you read that POTUS Trump would cancel the AUKUS partnership please consider the history, the private meetings held after the official dinner in Washington held to honour Prime Minister Morrison at one of President Trump’s private homes over a weekend. They discussed revival of the Quad defence arrangements between India, Japan, Australia and the USA, and they discussed what became the AUKUS partnership between Australia, United Kingdom and United States of America.
AUKUS was signed late in 2021 by PM Morrison, PM Johnson and President Biden in England after the COP at Glasgow.
One of many AUKUS objectives is for the RAN to operate nuclear submarines, operational Virginia Class US nuclear submarines to be supplied and in between times RAN personnel to be trained on board US and UK nuclear submarines. The longer term objective design and construction of a new generation nuclear submarine for the three partner navies.
However the list of projects is long and as described by a US Congress member, AUKUS will be a “forever partnership”.

Trump wins North Dakota 84.6% to Halley’s 14.2%
“Trump won the North Dakota primary. Because he got more than 60%, he took all the delegates. Most media say he won. They seem not to want to report the actual numbers. Trump won 84.6% against Haley, taking 14.2%. We will see if she refuses to drop out after Super Tuesday. That refusal will warn that conspiracy is alive and well to hang in in hopes Trump can’t be nominated or is assassinated, and she wins by default. I thought Hillary was bad. At least Hillary knows how to pretend. Haley seems to lack finesse.”

So, with all the “debate” about Trump being disqualified under the US constitutions insurrection provisions, how do people here feel about the kind of laws we have in Australia that disqualify people from holding a seat in parliament? Like, if you are convicted of a crime that has more than a years jail as sentence, or are a bankrupt??
Should we have parameters, or just let anyone run regardless of character, background, behavior and just let the ballot decide??
Probably don’t want to go near the citizenship requirements as that dredges up the whole “birther” thing. 🙁
20
Criminals and bankrupts aren’t allowed to sit in US Congress either.
Who has been convicted of insurrection, charged even? The QAnon Sharman isn’t standing but he wasn’t charged with insurrection either.

In 2016/17 I was tossing a lot of water on a new lawn so I would put on my headphones and listen to Levin while watering.
Jo’s headline “jury of 150 million can rule on Trump” was what Levin said, and I consider him to be a scholar, when defending Trump against the trumped up charges. He asserts that the electorate IS a jury and that once elected POTUS is [or should be] a full time, all consuming job and the Constitution has in it protection against time wasting lawfare.
I have zero legal training so the nuances elude me and it was a while ago but you dispute Levin at your peril.
